10. DATA RETENTION

We retain your personal data only for as long as is necessary to fulfil the purposes for which it was collected, or as required by applicable Indian laws and regulations. The following general retention periods apply:

  • Enquiry and Contact Form Data – Retained for a period of up to 3 years after the closure of the matter or last interaction.
  • Customer and Business Relationship Records – Retained for up to 7 years as may be required under applicable commercial, tax, and regulatory laws.
  • Marketing Preferences – Retained until you withdraw consent or request deletion.
  • Website Analytics Data – Retained in aggregated, anonymised form; personally identifiable data deleted after 13 months.

Upon expiry of the applicable retention period, your personal data will be securely deleted or anonymised.

  • Right to Withdraw Consent – Where processing is based on consent, you may withdraw your consent at any time. Withdrawal will not affect the lawfulness of processing before withdrawal.
  • Right to Grievance Redressal – You have the right to have your grievances addressed by our Grievance Officer in a timely and effective manner.
  • Right to Nominate – You may nominate another individual to exercise your data rights on your behalf in the event of your death or incapacity.
  • Right to Complaint – You have the right to file a complaint with the Data Protection Board of India once it is constituted under the DPDP Act, 2023.

To exercise any of the above rights, please contact our Grievance Officer using the details in Section 15 below. We will respond to your request within the time periods prescribed under applicable law.

12. CHILDREN’S DATA

Our website and services are not directed at children below the age of 18 years. We do not knowingly collect personal data from children. In accordance with the DPDP Act, 2023, we will obtain verifiable consent from the parent or lawful guardian before processing any personal data of a child.

If you believe that we have inadvertently collected personal data of a child without appropriate consent, please contact us immediately at contact@horvertinc.in and we will take prompt steps to delete such data.

13. SECURITY OF YOUR PERSONAL DATA

If you are not satisfied with the resolution provided by the Grievance Officer, you may, once operational, escalate your complaint to the Data Protection Board of India as constituted under the DPDP Act, 2023.

We reserve the right to update or modify this Privacy Policy at any time. Any changes will be effective upon posting the revised Policy on our website with an updated “Effective Date.” We encourage you to review this Policy periodically to stay informed of how we protect your personal data.

For material changes that significantly affect your rights or the way we process your data, we will endeavour to notify you by email or through a prominent notice on our website and, where required by law, seek your fresh consent.

17. GOVERNING LAW AND JURISDICTION

This Privacy Policy and any disputes arising in connection with it shall be governed by the laws of India. Any disputes arising from this Policy shall be subject to the exclusive jurisdiction of the courts located in Chennai, Tamil Nadu, India.

Where any provision of this Policy conflicts with applicable Indian law, the stricter rule shall prevail to the extent required by such law.
